Terms and Conditions
These terms and conditions govern the contract between you (the client) and Wild Things Ltd, a company incorporated and licensed in Tanzania ("Wild Things TZ"), which is the contracting party responsible for delivering all ground-based travel services described on this website. Wild Things Safaris UK Ltd, a company registered in England and Wales, acts solely as a payment collection agent on behalf of Wild Things TZ and is not a party to the travel services contract. Receipt of payment by Wild Things Safaris UK Ltd does not create any contractual relationship between you and Wild Things Safaris UK Ltd in respect of the travel services.
By making a booking you confirm that you have read, understood and accepted these terms and conditions, and that you have the authority to do so on behalf of all persons included in the booking.
Wild Things TZ holds a current licence issued by the Tanzania Tourism Regulatory Authority (TTRA) and operates in compliance with Tanzanian tourism regulations.
1. Assumption of Risk
Clients' bookings are accepted on the understanding that clients have considered and appreciate the possible risks inherent in travel, and in particular in adventurous activities such as trekking, climbing, walking safaris, game driving and diving. Nothing in these terms excludes or limits liability for death or personal injury caused by Wild Things TZ's negligence, or for any other liability that cannot lawfully be excluded.
2. Minors
Bookings can only be accepted for persons under eighteen years of age when accompanied throughout the tour by an adult aged eighteen or over, who accepts full responsibility for the minor's conduct and welfare for the duration of the tour.
3. Accommodation Availability
In the unlikely event that accommodation is not available on arrival at a hotel or campsite confirmed to the client, Wild Things TZ undertakes to provide alternative accommodation of a category at least equivalent to that contracted, if available. Where equivalent accommodation cannot be sourced, Wild Things TZ will notify the client as soon as practicable and discuss available options.
4. Force Majeure
Wild Things TZ shall not be liable, and no compensation shall be payable, where the performance or prompt performance of our contractual obligations is prevented or affected, directly or indirectly, by circumstances amounting to force majeure. For the purposes of these terms, force majeure means any event or circumstance beyond our reasonable control, including but not limited to: war, invasion, acts of foreign enemies, hostilities, civil war, rebellion, revolution, insurrection or military power; riot or civil commotion; acts of terrorism; strikes or industrial disputes involving third parties; epidemic or pandemic declared by a competent authority; natural disasters including earthquake, flood, volcanic eruption or extreme weather; fire; closure of airports, ports or borders by governmental or regulatory authority; or any act, decree, legislation or regulation of any government or supranational authority.
In the event of force majeure, Wild Things TZ will use reasonable endeavours to offer a comparable alternative holiday or, where this is not possible, a refund of monies paid, less any non-recoverable costs already incurred and less the non-refundable deposit.
5. Alterations to Bookings Whilst Abroad
No credit or refund is available for any services included in your tour that are not used once the tour has commenced. If you choose to alter your travel arrangements after the tour has begun, this is entirely at your own risk and expense. Wild Things TZ accepts no responsibility for any additional costs, losses or difficulties arising from such alterations, including any impact on onward travel arrangements.
6. Adventure Activities
For clients undertaking trekking, climbing or similar itineraries, Wild Things TZ will provide qualified guides, porters and appropriate safety equipment. Wild Things TZ is not responsible for the conduct, decisions or actions of guides and rangers assigned by the Tanzania National Parks Authority (TANAPA) or any other statutory authority, who operate under their own authority and regulations. However, Wild Things TZ retains a duty of care in the selection of itineraries and in its coordination with such authorities.
If you are required to abandon an activity due to your own physical limitations, medical condition, or failure to meet the fitness requirements communicated to you prior to departure, no refund of park fees or permit costs will be made, as these are paid directly to regulatory authorities and are non-recoverable. Any additional accommodation or transport costs incurred as a result are your responsibility. You may be required to sign a disclaimer or acknowledgement form prior to participation in certain activities.
7. Flight Delays and Missed Connections
Wild Things TZ sells ground arrangements only. Flights are not included in your contract with Wild Things TZ. In the event of a flight delay, responsibility for meals, overnight accommodation and related costs rests with your airline under applicable air passenger rights regulations.
If a flight delay means that additional transfers or logistical arrangements are required to enable you to join a group tour or commence your itinerary, the costs of such arrangements must be met by you and may be recoverable under your travel insurance policy. Wild Things TZ will use reasonable endeavours to assist but cannot guarantee availability or absorb costs arising from third-party delays.
8. Pricing and Price Variation
Quoted prices are based on exchange rates and supplier costs at the time of the most recent update to this website. Prices may be varied at any time prior to Wild Things TZ's written acceptance of your booking. After acceptance, prices may only be varied in the following circumstances:
- Changes in the cost of fuel or other energy sources affecting transport
- Changes in the level of taxes, park fees or entry charges imposed by governments or regulatory authorities
- Changes in relevant exchange rates
Wild Things TZ will absorb cost increases equivalent to up to 2% of the total tour price. Where a price increase exceeds 8% of the total tour price, you will have the right to cancel and receive a full refund of all monies paid, excluding the non-refundable deposit. You must exercise this right within fourteen days of being notified of the increase. Wild Things TZ will not increase prices within twenty days of your departure date.
9. Deposit and Payment
A non-refundable deposit of 30% of the total tour price is required to confirm a booking. The remaining balance must be paid no later than eight weeks (56 days) before the tour start date. Where a booking is made within eight weeks of the tour start date, the full amount is payable at the time of booking. Travel insurance must be in place before any payment is made — see clause 12.
Failure to pay the balance by the due date entitles Wild Things TZ to treat the booking as cancelled, in which case the cancellation charges set out in clause 10 will apply. Late bookings may be accepted at the discretion of the Directors.
All payments made to Wild Things Safaris UK Ltd are collected solely as agent for Wild Things TZ. Payment to Wild Things Safaris UK Ltd constitutes payment to Wild Things TZ for the purposes of this contract.
10. Cancellation by the Client
Cancellation must be made in writing. Email to our confirmed booking address is acceptable. Cancellation takes effect from the date the written notice is received by Wild Things TZ or its agent. The deposit is non-refundable in all circumstances. The following additional cancellation charges apply as a percentage of the total tour price:
- More than 90 days before the tour start date — deposit only (no additional charge)
- 60 to 89 days before the tour start date — 50% of total tour price
- 30 to 59 days before the tour start date — 75% of total tour price
- 29 days or fewer before the tour start date — 100% of total tour price
These charges reflect the costs and commitments incurred by Wild Things TZ upon confirmation of your booking. Where any of our suppliers impose cancellation terms stricter than those set out above, the stricter terms will apply and you will be notified of this at the time of booking or as soon as we become aware.
We strongly recommend that you take out travel insurance that includes cancellation cover from the date of booking.
11. Cancellation or Significant Alteration by Wild Things TZ
Wild Things TZ reserves the right to cancel or significantly alter a tour prior to departure. A significant alteration includes a major change to the destination, the duration of the tour, or the standard of accommodation. In such circumstances, Wild Things TZ will notify you as soon as reasonably practicable and offer you the choice of:
- Accepting the alteration
- Transferring to a comparable alternative tour if available
- Cancelling and receiving a full refund of all monies paid, including the deposit
Where cancellation by Wild Things TZ is not caused by force majeure and occurs fewer than 56 days before departure, compensation may be payable. The amount will be assessed on a case-by-case basis having regard to the circumstances. This clause does not apply to minor itinerary adjustments made necessary by operational requirements, weather or safety considerations.
12. Travel Insurance
Comprehensive travel insurance must be in place before any payment is made to Wild Things TZ or its agent, including the deposit. By submitting a deposit or any other payment you are confirming that a suitable policy is already held. A booking will not be accepted from any client who does not hold, or does not intend to hold, adequate travel insurance for the full duration of the tour.
Your policy must be appropriate to the nature of your holiday and must specifically cover the activities you intend to undertake, including but not limited to trekking, climbing, diving or any other adventurous activity. The policy must include cover for:
- Cancellation and curtailment, including loss of deposit
- Medical expenses and hospitalisation
- Emergency evacuation and repatriation
- Personal liability
Evidence of a valid policy must be provided to your tour guide at your initial meeting on arrival. Wild Things TZ reserves the right to refuse participation to any client who cannot produce evidence of adequate insurance.
Insurance claims — documentation. Where a client needs to make an insurance claim in respect of a deposit paid or tour costs incurred, Wild Things TZ will, upon written request, provide within a reasonable time any documentation reasonably required to support that claim. This includes, but is not limited to, a booking confirmation letter, a written statement of the amounts paid and the basis on which they are non-refundable, and, where applicable, written confirmation of the circumstances giving rise to the cancellation or curtailment. Wild Things TZ will not charge for the provision of such documentation. Clients are responsible for submitting claims to their insurer within any time limits set by their policy.
13. Travel Documents and Entry Requirements
You are solely responsible for ensuring that all members of your party hold valid passports, visas, health certificates, vaccination records, international driving permits and any other documents required for entry into Tanzania or any other country included in your itinerary. Wild Things TZ accepts no liability for any loss, delay or additional cost arising from failure to hold the correct documentation. Requirements may change and you should verify current entry requirements with the relevant embassies or consulates and with your own government's travel advisory service before departure.
14. Health and Fitness
Clients are responsible for ensuring they are in a suitable state of health to undertake the activities included in their chosen tour. Where a tour involves strenuous physical activity, minimum fitness requirements will be communicated to you prior to booking. Wild Things TZ reserves the right, in consultation with guides or medical personnel, to exclude a client from all or part of an activity on safety or health grounds. No refund will be due where exclusion results from the client's own health or fitness.
You should consult your doctor regarding recommended vaccinations and health precautions for travel to Tanzania prior to departure.
15. Complaints
If you have a complaint during your tour, you must raise it immediately with your tour guide or the Wild Things TZ representative on the ground, so that reasonable steps can be taken to resolve the matter at the time. Failure to do so may affect your right to claim compensation later. If the matter is not resolved to your satisfaction during the tour, you must submit a written complaint to Wild Things TZ within 28 days of the end of your tour. Wild Things TZ will acknowledge your complaint within 14 days and provide a substantive response within 28 days of acknowledgement.
16. Governing Law and Jurisdiction
This contract is governed by the laws of the United Republic of Tanzania. Any dispute arising out of or in connection with this contract shall be subject to the non-exclusive jurisdiction of the courts of Tanzania. Nothing in this clause prevents a client who is a consumer resident in the United Kingdom from bringing proceedings in the courts of their place of residence where they are entitled to do so by applicable law.
17. Data Protection
Personal data provided in connection with your booking will be processed by Wild Things TZ and, where necessary for payment processing, by Wild Things Safaris UK Ltd, for the purposes of administering your booking and delivering the contracted services. Data may be shared with suppliers, park authorities and other third parties to the extent necessary to fulfill your itinerary. Wild Things Safaris UK Ltd processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. 18. Severability
If any provision of these terms and conditions is found to be invalid, unlawful or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from the remaining terms, which shall continue in full force and effect.
19. Entire Agreement
These terms and conditions, together with the booking confirmation issued by Wild Things TZ, constitute the entire agreement between you and Wild Things TZ in respect of the contracted services and supersede all prior representations, discussions or agreements.
These terms and conditions were last reviewed in 2022. Wild Things TZ reserves the right to update these terms. The version in force at the time your booking is accepted will apply to your contract. You are advised to retain a copy of the terms applicable at the time of booking.
